Terms of Service

The Service is operated by PawfectPix ("we", "us" or "our" (a sole trader, not a company)), an individual or sole trader operating under the laws of the People's Republic of China. Our contact details are in Section 16.

These Terms cover It turns a photo of your pet into a stylised portrait generated by Google's Gemini Nano Banana 2.1 (nano-banana-2.1) or OpenAI's GPT Image 2.5 (gpt-image-2.5) image model, whichever you pick, and can optionally add a short, light-hearted personality description written by Google Gemini 2.5 Flash., delivered as a software-as-a-service product over the internet.

By creating an account, subscribing to a plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood and agree to be bound by these Terms; (c) agree to our Privacy Policy at https://www.pawfectpix.art/privacy; and (d) are authorised to enter into this agreement on behalf of yourself or any organisation you represent.

If you do not agree to these Terms, you may not use the Service. Continued use after an update constitutes acceptance of the revised Terms.

2.1 What We Provide

PawfectPix is a digital software-as-a-service product that you access through a web browser. It turns a photo of your pet into a stylised portrait generated by Google's Gemini Nano Banana 2.1 (nano-banana-2.1) or OpenAI's GPT Image 2.5 (gpt-image-2.5) image model, whichever you pick, and can optionally add a short, light-hearted personality description written by Google Gemini 2.5 Flash.

2.2 The AI Models We Use

Portraits are produced by one of two image models, which you choose on the create page: Google's Gemini Nano Banana 2.1 (model identifier nano-banana-2.1) or OpenAI's GPT Image 2.5 (model identifier gpt-image-2.5). The optional personality description is written by Google Gemini 2.5 Flash. We reach all three through Grsai, an API provider that supplies access to them; Grsai is not the developer of any of these models.

We name the models because the choice changes the result: Nano Banana 2.1 is the stronger of the two at preserving your pet's actual face and is the only one that outputs 1K, 2K or 4K; GPT Image 2.5 paints more boldly and outputs 1K only. The models behind the Service may change as providers release new versions; when that happens we update this section, the create page and the Privacy Policy, and we do not apply a change retrospectively to work already delivered to you.

2.3 Nature of the Service

The Service is a digital, intangible product. Access is granted as soon as your payment is confirmed, which means you receive the benefit of the Service immediately. Specific limits apply to refunds as a result — see Section 7.

2.4 Changes to the Service

We may add, change or remove features. If we discontinue the Service altogether, we will give you reasonable advance notice and refund any prepaid amount that you have not yet had the benefit of.

3.1 Account Creation

You must create an account with accurate and complete information to use the Service. You are responsible for keeping your login credentials confidential and for everything that happens under your account.

3.2 Account Security

• Tell us immediately at wyzycao@gmail.com if you become aware of any unauthorised use of your account.
• Do not share your credentials with anyone else, and do not resell access to your account.
• Keep the email address on your account up to date — it is how we send billing notices, receipts and security alerts.

3.3 Business Accounts

If you register on behalf of a company or other organisation, you confirm that you have authority to bind that entity to these Terms.

We sell one-off credit packs only. There is no subscription, no recurring billing, and nothing renews. Current packs and prices are always shown at https://www.pawfectpix.art/pricing before you reach checkout.

Credits are the unit of consumption in the Service. One 4K portrait costs 10 credits, whatever the style or model. We may change pack contents or prices prospectively, but a change never applies to credits you have already bought.

If the image service fails, times out, or refuses your photo under its content policy, the credits for that attempt are returned to your balance automatically and that attempt is not charged.

5.1 Credit Pack Purchases

Each purchase is a one-time transaction. By completing the purchase you authorise us to charge your payment method for the amount displayed at checkout. Credits are added to your balance once the payment is confirmed.

5.2 Credits Are a Single Balance

All credits bought on your account are held in one combined balance, whichever pack they came from. Consequently we do not distinguish their order of use, and your balance may become negative after a refund (see Section 7).

5.3 Payment Processing and Taxes

Payments are processed by our merchant of record, Waffo Pancake. Waffo Pancake is the seller of record for your purchase and handles payment collection, tax determination and remittance. Your card details are handled by Waffo Pancake and are never stored on our servers.

Unless stated otherwise, prices are exclusive of applicable taxes. Where the law requires it, Waffo Pancake collects and remits taxes such as VAT, GST or sales tax.

The Service does not offer subscriptions and does not keep a payment method on file for future charges. Nothing renews, so there is nothing to cancel.

If you believe you have been charged twice for the same pack, or charged without completing a purchase, email wyzycao@gmail.com with your account email and the transaction reference. We investigate every such report and refund any charge we cannot account for.

7.1 General Position

Because the Service is digital and access is granted immediately, charges are generally non-refundable. The exceptions below are real and we honour them.

7.2 Refunds You Are Entitled To

• Unused credits within 7 days: a credit package that you have not used at all can be fully refunded within 7 days of purchase.
• Duplicate or incorrect charge: any charge caused by a billing error on our side is refunded in full.
• Verified outage of 72 hours or more: if you could not use the Service for 72 hours or more because of a failure within our control, you are entitled to a pro-rated refund or an equivalent credit.
• Statutory rights: if the law of your country gives you a right of withdrawal or a refund right that is wider than the above, that right is unaffected by this section.

7.3 How a Refund Affects Your Credits

When we refund a payment, we withdraw the credits that payment granted, in proportion to the amount refunded. Credits that have already been consumed are still withdrawn, so your balance may become negative. A negative balance is not an error and is settled against your next purchase.

7.4 What We Do Not Refund

• Credits that have already been consumed.
• Accounts terminated because of a breach of these Terms or of our Acceptable Use Policy.

7.5 How to Request a Refund

Request a refund from the Consumer Portal at https://pancake.waffo.ai/consumer/portal/login, or email wyzycao@gmail.com with your account email, the transaction reference and the reason for the request. We acknowledge requests within 2 business days and process eligible refunds within 10 business days. Refunds are returned to the original payment method.

If you believe a charge is wrong, please contact us at wyzycao@gmail.com before raising a dispute with your bank or card issuer. We commit to responding within 2 business days and to resolving confirmed billing errors within 5 business days.

9.1 Our Rights

PawfectPix and its licensors own all rights in the Service itself, including its software, interface, design, text, graphics and trade marks. Nothing in these Terms transfers ownership of any of that to you.

9.2 Your Licence to Use the Service

Subject to these Terms and to payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your own internal purposes. You may not resell, sublicense or otherwise make the Service available to third parties without our prior written consent.

9.3 Content You Submit

You keep ownership of the data and content you submit to the Service. You grant us a limited, non-exclusive licence to process that content solely to operate the Service and provide it to you.

Your use of the Service must comply with our Acceptable Use Policy at https://www.pawfectpix.art/aup, which forms part of these Terms. It sets out what you may not do with the Service and what happens when that is breached.

Breaching the Acceptable Use Policy is a material breach of these Terms and may result in suspension or termination of your account.

Our handling of your personal information is described in our Privacy Policy at https://www.pawfectpix.art/privacy. Payment card data is processed exclusively by our PCI-DSS compliant merchant of record, Waffo Pancake, and is not stored on our servers.

Account and order data is retained as described in the Privacy Policy — currently, account data is retained for 30 days after you close your account and is then deleted.

12.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

Nothing in these Terms excludes or limits any warranty or right that the law of your country does not allow to be excluded or limited, including your statutory consumer rights.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PawfectPix IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

These Terms remain in effect for as long as you use the Service. You may stop using the Service and close your account at any time by contacting wyzycao@gmail.com.

We may suspend or terminate your account if you materially breach these Terms or the Acceptable Use Policy, if we reasonably suspect fraud or a payment dispute raised in bad faith, or where the law requires it. If we terminate your account for a reason other than your breach, we will refund the unused portion of any prepaid amount.

Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — continue to apply.

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict of laws rules. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your country of residence.

Before starting formal proceedings, please contact us at wyzycao@gmail.com so that we can try to resolve the matter informally. We will attempt to resolve any dispute within 30 days of receiving your notice.

We may update these Terms from time to time. If a change is material, we will notify you by email at least 15 days before it takes effect. If you do not agree with the change you may stop using the Service and close your account before it takes effect.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with a merger, acquisition or sale of assets, on notice to you.

These Terms, together with the Privacy Policy and the Acceptable Use Policy, are the entire agreement between you and us regarding the Service.
